Algerian ministry of justice creates website for citizens

As part of its ongoing modernisation project, Algeria's Ministry of Justice launched a new electronic tool to reach out to its citizens and save time.

The Algerian Ministry of Justice opened a new portal on its website to receive inquiries and facilitate citizen access to legal information. The feature was launched on the Ministry of Justice website (www.mjustice.dz) on Saturday (March 7th).
"The Ministry of Justice created the portal based on several inquiries received from citizens, who usually have to go to Algiers to obtain legal information. And in most cases, these requests do not necessitate the trouble of movement," said Director of Modernisation of Justice Abderezak Hani.
The new tool will save time, facilitate citizen access to information, and spare them the trouble of resorting to legal advisors and lawyers.
Hani described the window as an "important innovation", which supports "the public service policy of getting justice closer to the citizen".
Algeria began implementing judicial reforms in 2001, following the recommendations of a panel of experts assigned by President Abdelaziz Bouteflika to prepare a report on the national justice system. The Ministry of Justice issued over 40 legal provisions as part of the reform, and has recently presented to Parliament legislation aimed at combating e-crime. The draft bill will be debated after the April 9th presidential elections.
Citizens can use the new web portal to obtain legal information – such as the text of new legal provisions or amendments – or to request appointments with officials.
"The citizen can obtain a direct and personalised answer sent to his or her email inbox by a cell consisting of judges, legal experts and officials in the Ministry of Justice," explained Hani.
The Ministry of Justice has also provided its website with a forum "through which a general discussion is organised with citizens on the important issues of the hour. The purpose here is to disseminate a legal culture," he said.
Reception offices on the level of all courts and judicial councils had already been opened, and these latest electronic tools have come to complement such existing reforms.
"The opening of the [electronic] window represents a step towards winning the trust of citizens in their justice system," said Sonia Biskere, a media official in the Ministry of Justice. Citizens can now "obtain criminal record certificates and nationality certificates in record time by submitting an application through the Ministry’s internet website."
Various national media outlets have been promoting the window.
"I am a computer and internet addict," said Fateh Layadi, an information technology employee. "Therefore, this will save me much time."
"Will those tasked with the management of the window be able to respond to all the requests they receive from thousands of citizens?" he wondered. "It is necessary for officials in the Ministry of Justice to follow up on this window so that citizens' messages are not ignored."
Abdelhamid, 40, was affected by the security crisis in the country in 1990s, and confirmed that he has had to travel repeatedly from the city of Jijel, 380 kilometres to the east, to Algiers to make inquiries about the 2005 Peace and National Reconciliation measures. "If this internet-based technique had been adopted since that date, I wouldn't have incurred all these transportation expenses," he told Magharebia.

This is good, but also insufficient. True reform would be putting the court decisions online so that whenever any judge makes a ruling, they will have to keep in mind that their decision will be accessible to the largest possible number of people. I can also assure you that the countries that have implemented these sorts of reforms have seen a wonderful reduction in corruption in the courts.

I am very happy with this move witnessed by the Algerian ministry of justice especially in the modern era of globalization. My hope is its progress and prosperity in its endeavours to educate the Algerian people in law and just law. I have a dream and ask God to make it true. It is the absolute independence of justice from authority. I hope to see with my eyes a senior political figure for example prosecuted like other citizens and they publish the minutes of their trial through all the media. Concerning voting (probe the opinions of the Algerian people) on the issue of opening borders with the brotherly Morocco, I put my voice as a legacy on the minister of foreign affairs for which he will be accountable before God as he knows better what should be done. This is the story. One of the woman teachers went after completing her work in the school located in the village to the roadside to wait for transport. A car with four young men stopped, kidnapped her and did her act of her. A truck driver saw them and protected her after what they did. However, the catastrophe happened in court after the case was presented by national gendarmes to the prosecutor of the republic in the court of Ksar Chelala. Before this I will give you a few details. The victim, called Fatima Zahra, identified the defendants 1- Bekas Kamal, 2- Benguerna Mensour. 3... 4... before the prosecutor of the republic. Just a question, what is the attitude or legal procedure to be adopted in this case. The case was recored against an unknown side. This caused a lot of fuss in the region especially in the court. Now we are scared about him every time we go to the court. We feel as if we are in a war arena. We find our Cesar in the place of the guard. All we hear from him is what are you doing here by God? Why are you dressing up like this? So we don't know what to wear. When we discuss with him the delay in getting papers such as the criminal record, he becomes angry. So how can we address him? He neglects the most important things including some old complaints and cases which he stumbled with his big anklet. Some complaints and cases are pending for over 8 months. They are in deep sleep waiting for someone to wake them. Will someone come to wake them? You can if you want of course. We are in an era where the world is fighting dictatorship and trying to create organization, peace, progress and civilization not violence. But we are still in the era of backwardness. Ouf! A small town deprived of everything including justice we don't take our right to it. Most judges here are sanctioned. Isn't this unjust? All those who are sanctioned are sent to us. Our court has become an exile. This is odd. There is the absence of security? When you go downtown, you don't see a single police officer. Yes no organization just diversion. So what is the solution? From what I noticed since I began work in the court in 2003 to this day that only external candidates pass, meaning they have never even entered the court to get a criminal record or nationality certificate. This lack of trust has a serious impact in society. This is because the head of justice is the king. It is the only and certain guarantee to preserve the stability of society and its progress by ensuring political rights of individuals in the face of new data including the support of the proof of evidence firstly to the issuance of legal rulings then to follow the policy of social reintegration for prisoners, ensure subsequent care for them and everything that might draw a fair policies which leaves a good impression among members of society. This not the result of the lack of legal texts, human or material structures, it is rather the absence of mentalities and special understanding of these legal texts which are interpreted according to the inclinations of law enforcers. This has a negative impact for members of society towards active members who has shown their good intentions. This negative impact doesn't target people who originally caused this as a result of their misunderstanding of the applications of legal texts. As an example to this, there is a simple example endured by thousands of Algerian families. This attracted our attention recently Mr the minister after the adoptions of the two decrees about pardon measures in favour of prisoners excluded from pardon measures and those who benefit from the reduction of the sentence in case they are studying, those who passed the baccalaureate and those who joined vocational training. This is quiet normal. However, the unusual matter is what we have noticed in the deprivation of people from pardon or sentences reduction measures under the pretext that they haven't obtained the diplomas of training although they are practicing vocational training and having successfully passed the end of training exam. But others who have also passed successfully in their studies benefited from these measures although they all have the same legal status. So the trainees deserve more to benefit from them. We hope that you will interfere immediately at the the general administration of prisons. Special thanks.

Oh people, listen and learn. The past is the past and the future is still head. Have we had independence in 62 or are we still enduring colonization and underdevelopment? This question can be perplexing somehow. We are in 2009 and still endure anarchy, mismanagement, but worse of all is the impoliteness of law representatives. In a time when the world is moving at a high speed, we are still enduring violence and delay in getting official documents. As an Algerian citizen who has patriotism and concern about my country for whom a million and half a million martyrs were sacrificed so that the nation lives in pride, dignity and freedom, not that one day there will be dictatorship and bureaucracy. I change what I can change even with a few lines which express the endurance of a whole town especially employees in the court of Chelala by the hands of the prosecutor, representative of the ministry of justice called B.Gh. S. He has created a gap between the presidency and public prosecution in the attitude towards people and management. We were scared to have a woman president of the court. We used to say how can a woman preside the court. So we praised to God ---When you face death, you become scared of fever. Pure wheat is not like barley---The prosecutor of the republic has created a troubled and polluted environment as if he was Youssef Al Hajjaj. Yes, this is the result of the lack of control by officials. There is a total absence of inspectors. The proof is that the number of complaints by citizens have increased but no official side reacted. This is odd. If our cases and complaints were filed over 8 months ago but it hasn't moved a finger. The oddest thing is that he is in constant dispute with security agents and gendarmes to the point that he expels them from the court in public. Are all public prosecutors like this? Are all prosecutors of the republic taught to insult and to bribery in their training? Are all officials like this? Does law say that the prosecutor isn't accountable for his acts? Or are we in the gloomy policy of tunnels or when responsibility is feminine? The oddest thing is that the president of the republic says that he seeks development, stability, fight corruption or is all this fancy? It is so nice to live in a free land enjoying freedom, development and contribute to progress but not with people like this...

I have applied for a criminal record certificate at the court of Ksar Chelala, the judiciary council of Tiaret. However, I was surprised to find a man in the court shouting and insulting everyone he meets. He insulted me though I have not talked to him. He sent me away without giving me the certificate. I applied for a birth certificate two days ago but the special secretary of the prosecutor of the republic always says he is absent. Your Excellency the minister, although I have filed a plaint at the public prosecutor in the province of Tiaret, this was without result. Employees who control your authority at the local level in Ksar Chelala are skilled in the abuse of power. I have great hopes in you as you are the guardian of rights; restore my right to me.

What risks face judges who have violated the law, who whimsically give verdicts and make rulings against the law, who behave like God Himself towards the modest, defenceless people on trial, mistreating them? The answer is: ABSOLUTELY NOTHING! Judicial reform should first of all deal with this and force judges to obey the law alone and nothing but the law, at the risk of finding themselves at the stand and suffering grave consequences. Such is not the case now, as the judges obey only their conscience (!?) or those who protect them, the Members of the High Council of Judges! Reform that aims to create beautiful courts without taking care of the quality of the rulings is worthless.

It is unreasonable that the public prosecutor interferes in the health sector by issuing a statement concerning the major hospital in the district of Ksar Chelala. He said we have noticed that yoy have issued suspicious certificates to the clerks of the court...Sir, isn't this a violation of law? If he has any doubt about medical certificates issued by the competent doctor, there should be an investigation. The worst problem is that the statement was posted on the walls of the hospital. There is no need for this if the issue concerns the doctor. You have all consideration.

After reading one of the comment on this window about the abuse of a public prosecutor, my curiosity drove me with impartiality and objectivity to interest in this person. The first thing I did was to make sure about the correctness of a comment about posting an instruction inside a hospital in the town of Ksar Chelala addressed to doctors and clerks of the court. When I first began reading it, I thought I was in a court, Judiciary Council of Tiaret, court, public prosecution, public prosecutor, seal of the public prosecution…I understood one reality to many questions. This individual endures a psychological situation through which he tries to impose himself by these acts. This is the result of the absence of self-confidence, failure to assume responsibility as he tries to impose himself outside the court and become the manager of a hospital. We congratulate him for this new function and for dropping his primary functions: code of criminal procedure. Even the subject of the instruction is dealt with through specific measures and original perpetrators bear the responsibility of this act. I am astonished to see many complaints about a specific court – Ksar Chelala- against a specific person – the prosecutor of the republic – as if this site was dedicated to him alone and to complaints against him. Can't you put an end to these problems? Or it is better to close this site because in the face of every new complaint, the citizen understands that this site is for deluding and releasing the anger of hearts... In reply to the question of the doctor about the error committed by the public prosecutor of the republic in Ksar Chelala is a violation of law. Salam alikum. Through my reading of some comments on this site, I wanted out of curiosity to discover this person subject of these complaints to which the site was dedicated. The first thing I did was go to this court under the pretext of applying for a nationality certificate to inspect closely the acts of this person, Mr the prosecutor. I discovered the presence of one person going to and fro from the examination office and the office of the prosecution. He talks to citizens to inquire about their needs and requests. He also orders agents in charge of serving citizens to speed up process of their concerns. This is not all. I also discovered that he doesn’t leave the office of the presidency of the court to carry out his assigned jobs. This person does the duties of the prosecution, examination and supervision of the presidency of the court without any violations or abuse of the freedom of the people. Everyone who entered the court that day was in safe hands and happy because he felt some kind of flexibility in the treatment of that person and found right guidance. I was surprised to find such kind of people who are persevering, responsible and appreciate the nature of their duties towards us. However, we don’t talk about these people. We only talk about people who have no sense of responsibility and humanity. I was very disappointed when I thought that this person was the public prosecutor subject of many complaints. I discovered that this young, smart, hard-working and active judge wasn’t the public prosecutor. He was the examining judge of the court of Ksar Chelala as I wanted to refute what was written on the site. This young man did his job more than a responsible public prosecutor, did his missions more than a responsible president of the court and did his job as examining judge with responsibility. We in turn encourage him in his work and wish him success. Special thanks to the trainers of such judges in the high school of magistrates. May God rest the souls of his parents.

This is what has increased abuses in the town of Ksar Chelala...There is one individual called Yahya Char, he is under police arrest for over 4 days which is the legal period. The cause is that he was caught while driving his motorcycle and was dashed from the back by a police vehicle. This made him fall and caused him serious injuries. There is a famous Egyptian proverb which says still waters run deep, there are many people accused wrongly in prisons. You should know that God has not put any veil between Him and the prayer of the oppressed. On the other hand, God will retaliate for the oppressed sooner or later. The messenger of God, peace and prayer be upon him, was right when he said that God delays the oppressed but when He takes him, he retaliates in a good way. This is the way of God the Almighty. But from the civilization side, this state will not succeed unless its justice and education are reformed. If we want stability, we must take care of these two pillars. You must ask yourselves this question: why haven't caught up with the west? Why has this west we describe as civilized have reached this technological and civilization progress? Why do their peoples enjoy stability and why do our sons Harraga throw themselves in destruction hoping to reach the land of Chritsians to grant them justice and offer them a place among them for dignified living even if the job requires removing the garbage of Christians? Unfortunately, you have killed in this citizen all principles especially nationalist which we used to feel in 1960's and 1970's. At the time there was no single Algerian who were thinking of Harga in general. But as it is said, a condition can persist eternally. The day will come when we will be judged whether we are rulers or ruled. Then we will see who will win. He ordered that our letters be collected but he hasn't replied to this day. The issue is that someone leased a land from me and the duration of the lease is over. But he doesn't want to leave it. Even police were of use with him. I have no paper to prove that the land is mine. But he has owned up that the land is mine. My early dropping-out of school made me almost isolate myself from all the people. A greeting to all the people. This attitude led me to stay away from courts and police stations. I am just asking for advice in order not to make a mistake. It is in my nature that I love discovering things by myself. I don't listen to what is said about the situation of the country. I always knew that the country is well as long as our president is well and the few who love this dear country. But I fell in a problem and flagrant injustice which my heart couldn't grasp. So I decided to know what is going on in my country. I went to ask for the advice of others but many advised giving bribes, but a few of those who consider our president as an example advised to follow legal ways. But the legal way made me wait for a long time and ultimately I came out without a right to what I was seeking. The right was granted to someone who was acquainted with influential people and who were humiliating themselves to them. I found myself not equal to others. I should either offer bribes or humiliate myself in the country of pride of dignity. Had I offered bribes, I would have received what I wanted in two days. Salam alikum. I have an order from the court of El Harrach on September 15, 2009 with a writ of execution against my uncle to stop works on a common land and building without authorization. However, justice punishes only those who are presented for it. Most of them are weak people who have no will and no power, or people who don’t believe in bribery, who love to live in dignity. But those who love the company of influential people, who humiliate themselves before them and believe in bribery, aren’t presented for justice. So how can they be made accountable for their deeds? I am an old woman; I live in the province of Tibessa. I was born in 1926 in the province Tibessa of a foreign father and Algerian mother. I married a Moujahid in the glorious liberation war. We had daughters and sons. I lived my life without an identity card showing that I am still alive. I have presented my case to the ministry. They required a birth certificate of my mother, her father and grandfather. But they are not registered in the civil status. So I have to register them. Some of the conditions of registration are two witnesses who know the persons concerned. If I am born in 1926, in which year would the grandfather of my mother have been born? Would I find witnesses who know them and who have lived in that period? By the way, I have presented an application to register my mother and my request was refused as it was not founded. They told me: Since you hadn’t proved her existence while she was still alive, it was impossible to do so after her death. Concerning the issue of opening borders with Morocco, I suggest that the authorities open the borders, but with conditions. Morocco and Algeria are one people. We have no animosity against them. As regards the Western Sahara, I suggest that the Algerian state divide this region with Morocco. As regards reform or development of justice, I suggest the following: The judge should not have a fixed salary. He should receive his wage whenever he wants to. Employees in the judiciary should have a salary ten times the basic salary. Providing housing for them should be mandatory, in addition to some facilities. I have also tried to contact the president. My problem is bigger than you can imagine. My family is the victim of people who cause injustice and who do not fear God.
